These Terms explain the rules for using KW Therapists as a therapy seeker, visitor, or listed therapist. Please read them before using the directory, matching quiz, contact forms, or therapist account.
The important parts
KW Therapists is a directory and matching tool, not a healthcare provider or emergency service.
Profiles are self-reported. We review for completeness but do not verify credentials or professional standing.
Quiz matches and directory rankings are informational, not clinical recommendations or guarantees.
Any therapy relationship, fees, privacy obligations, and professional services are between you and the therapist.
Therapists are responsible for accurate listings, lawful advertising, professional compliance, and the content they submit.
Acceptance and eligibility
These Terms of Service (“Terms”) are a binding agreement between you and KW Therapists governing your use of the website, directory, matching tool, inquiry forms, therapist accounts, and related services (together, the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You may browse on your own behalf or to help someone else. If you are under the age of majority, use the Service only with the involvement of a parent or guardian where appropriate or legally required. You must have legal capacity to create a therapist account or submit a listing. If you use the Service for an organization or practice, you confirm that you can bind it to these Terms.
Our Privacy Policy explains how we handle personal information. It is not part of these Terms and consent to privacy practices is addressed separately.
What KW Therapists is—and is not
KW Therapists is an information, directory, matching, and inquiry-relay service. We are not a healthcare provider, therapy practice, clinic, professional college, insurer, or emergency service. We do not provide therapy, diagnosis, treatment, medical or legal advice, clinical screening, case management, or professional referrals.
Using the Service does not create a therapist-client, patient-provider, fiduciary, agency, employment, partnership, or other professional relationship between you and KW Therapists. A relationship with a therapist can arise only through your separate dealings and agreement with that therapist.
Not for emergencies
The Service is not monitored as a crisis service and must not be used for urgent or emergency needs. If you or someone else is in immediate danger, call 911 or go to the nearest emergency department. In Canada, call or text 988 for suicide crisis support. Do not wait for a therapist or KW Therapists to respond to a website message.
Listings are information, not endorsements
Therapist profiles are submitted and maintained by the therapists who own them. KW Therapists reviews profiles for completeness and may review them for compliance with these Terms, but we do not independently verify credentials, registration status, professional standing, insurance, education, specialties, availability, rates, identity claims, or any other profile statement.
A listing, search position, profile badge, match result, or approval for publication is not an endorsement, recommendation, credential check, or guarantee by KW Therapists. Before receiving services, verify the therapist's registration and standing directly with the applicable Ontario regulatory college, ask questions, and decide whether the therapist is appropriate for your needs.
Search and matching results
Filters and quiz results are generated from the choices you make and information therapists provide about themselves. Results are designed to narrow a directory; they are not a clinical assessment and do not determine who is safe, qualified, available, or suitable for you.
Ranking and matching methods may change over time. Directory order may rotate or use relevance, availability, profile quality, engagement, or clearly labelled promotional factors. We do not guarantee that results are complete, error-free, or the best possible match, or that a listed therapist will accept you as a client.
Inquiries and therapist relationships
When you use a profile's contact form, KW Therapists relays your message by ordinary email to the therapist you selected. We do not review the message in the ordinary course and do not store it in the application database, but our email provider processes it for delivery. Email is not guaranteed to be confidential, secure, or delivered.
The therapist—not KW Therapists—is responsible for deciding whether to respond, accept you as a client, obtain informed consent, protect health information, provide professional services, bill for services, and comply with professional and legal obligations. Fees, insurance, availability, cancellation rules, telehealth arrangements, and the terms of therapy must be agreed directly with the therapist. KW Therapists is not a party to those arrangements or responsible for a therapist's acts, omissions, advice, services, or communications.
Therapist accounts and listing obligations
If you create a therapist account or listing, you are responsible for your account, profile, professional conduct, and use of inquiries. You must promptly update information that becomes inaccurate or misleading.
Provide complete, current, and truthful information and do not exaggerate qualifications, outcomes, demand, or areas of competence.
Hold and maintain every registration, authorization, insurance policy, consent, and permission required for your practice, advertising, and submitted content.
Practise only within your competence and professional scope, follow applicable college standards and laws, and protect inquiry information appropriately.
Use a secure account, keep access credentials confidential, and notify us promptly of suspected unauthorized access.
Submit only content you own or have permission to use, including consent from identifiable people appearing in photos or video. Do not upload client information, testimonials, case material, or other confidential information without a lawful basis and all required consents.
Do not treat a lead, profile view, quiz match, or directory statistic as a guaranteed client or revenue result.
Profile content and intellectual property
You keep ownership of content you submit. You grant KW Therapists a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, crop, adapt for display, publish, distribute, and make that content available as needed to operate, index, and promote your listing and the Service. This licence lasts while the content is on the Service and for a reasonable period in backups and caches. You confirm that granting this licence does not violate anyone else's rights.
The Service itself—including its design, branding, copy, software, taxonomy, selection and arrangement of content, and non-user-created materials—is owned by KW Therapists or its licensors and is protected by intellectual property laws. Except for normal personal use of the directory, these Terms do not grant you a right to copy, modify, distribute, sell, license, or create competing materials from the Service.
Acceptable use
You must not use the Service to:
break the law, infringe rights, deceive, harass, threaten, discriminate, or cause harm;
impersonate another person, create a false listing, misrepresent credentials, or submit information without authority;
send spam, solicit therapists for unrelated commercial purposes, or misuse contact information;
probe, disrupt, overload, reverse engineer, bypass security or rate limits, introduce malicious code, or access data or accounts without permission;
scrape, harvest, copy, or build a database from listings at scale, except for standard search-engine or AI indexing that follows our published robots.txt, llms.txt, and other access instructions;
use Service content or data to train, evaluate, or operate a competing directory, lead-generation service, or commercial dataset without written permission.
Review, visibility, suspension, and removal
We may request changes, reject a submission, change a profile's visibility, suspend access, or remove content or accounts when we reasonably believe it is incomplete, inaccurate, unsafe, unlawful, misleading, infringes rights, violates these Terms, creates risk for users or the Service, or no longer fits the directory's scope. We may also preserve information and cooperate with regulators or law enforcement where legally required.
Therapists may ask to remove their listing or account through our contact page. Removal from KW Therapists does not control copies already made or cached by third parties. Provisions that by their nature should survive termination—including intellectual property, disclaimers, liability limits, indemnity, and dispute terms—will survive.
Third-party services and links
The Service links to therapist websites, regulatory colleges, crisis resources, and other third parties. It also relies on third-party infrastructure. We do not control or endorse third-party content, availability, security, privacy practices, or services. Your use of a third party is governed by your agreement with that party.
Service availability and changes
We may add, change, suspend, or discontinue features, eligibility criteria, ranking methods, or the Service as a whole. The Service may occasionally be unavailable or contain errors. Listings are free at present. If we introduce fees for an existing therapist feature, we will provide the affected therapist with the price and applicable terms before charging them; continued use of a paid feature will require agreement to those terms.
Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” KW Therapists disclaims all express, implied, and statutory warranties, including warranties of accuracy, completeness, availability, fitness for a particular purpose, merchantability, non-infringement, and results. We do not warrant that any profile, match, communication, therapist, or therapy service will meet your needs or produce a particular outcome.
Nothing in these Terms excludes a warranty, condition, right, or remedy that cannot lawfully be excluded.
Limitation of liability
To the fullest extent permitted by law, KW Therapists and its operator, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, opportunity, revenue, profits, goodwill, or business, arising from or related to the Service, a listing, a match, an inquiry, or a therapist's services—even if advised that such loss is possible.
To the fullest extent permitted by law, our total liability for all claims arising from or related to the Service will not exceed the greater of CAD $100 and the amount you paid directly to KW Therapists for the Service during the 12 months before the event giving rise to the claim. These limits do not apply to liability that cannot lawfully be limited or excluded.
Indemnity for therapist and business users
If you use the Service as a therapist, practice, or other business, you will defend, indemnify, and hold harmless KW Therapists and its operator from third-party claims, losses, liabilities, damages, judgments, penalties, and reasonable legal costs arising from your profile or submitted content, your professional services or communications, your breach of these Terms, your violation of law or professional standards, or your infringement of another person's rights. This section does not apply to the extent a claim was caused by KW Therapists' own unlawful conduct.
Governing law and disputes
These Terms are governed by the laws of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules. Unless applicable law requires otherwise, disputes relating to these Terms or the Service must be brought exclusively in the courts located in Waterloo Region, Ontario, and each party accepts those courts' jurisdiction.
If any provision is found unenforceable, it will be limited or removed only to the minimum extent necessary and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them as part of a reorganization, sale, or transfer of the Service.
Changes and contact
We may update these Terms as the Service changes. The “Last updated” date shows the most recent revision. If a change is material, we will provide additional notice where reasonable or legally required. Changes apply prospectively when posted or on the stated effective date. Your continued use after that date means you accept the revised Terms.
These Terms, together with any additional terms you expressly accept for a feature, are the entire agreement between you and KW Therapists about the Service. Questions about these Terms can be sent through our contact page.
